Terms of Service

These terms apply when you use the website design and hosting services provided by Resite. By approving your website and making payment, you agree to these terms.

“We”, “us”, “Resite” refers to Resite, operated as a sole proprietorship based in Cape Town, South Africa. “You”, “your”, “client” refers to the person or business purchasing our services.

1. The Service

Resite provides custom website design and development, website hosting, ongoing maintenance, security updates, and performance monitoring. All websites are built with modern web technologies as custom code — not using website builders or templates.

2. How It Works

  1. We build your site — We design and develop a fully functional website for your business at no upfront cost.
  2. You review it — We share a live preview link. You can request as many revisions as you need during this phase, free of charge.
  3. You approve and pay— Once you’re happy with the site, you pay the one-time build fee.
  4. We go live — Your domain is pointed to our servers and your site goes live, typically within the same day.

You are under no obligation to approve or pay for a site. If it doesn’t meet your needs during the review phase, you can walk away at no cost.

3. Pricing and Payment

Our services include a one-time build fee for the design and development of your website, payable once you approve the final design, and a monthly hosting fee for hosting, maintenance, and support, billed from the date your site goes live.

Specific pricing will be confirmed with you in writing before any work begins. All fees are exclusive of VAT unless stated otherwise. Monthly hosting fees are due at the start of each billing period. If payment is not received within 14 days of the due date, we reserve the right to suspend your website until payment is made.

4. Revisions

Before going live: You may request unlimited revisions at no extra cost. We want you to be completely satisfied before you commit.

After going live:Reasonable minor changes (text updates, image swaps, contact details) are included as part of your hosting. Significant redesigns or new feature requests may incur additional fees, which we’ll agree with you in advance.

5. Intellectual Property

Our code: Resite retains ownership of all website code, design, and technical assets we create. While your hosting is active, you have a licence to use the website for your business purposes.

Your content: You retain full ownership of all content you provide — text, images, logos, branding, and other materials. We will not use your content for any purpose other than building and hosting your website without your permission.

Code purchase:If you wish to obtain ownership of your website’s source code, you may purchase it from us for a separate fee. Contact us to discuss.

6. Domain Names

If you own your domain, you remain the owner and are responsible for registration and renewal — we’ll help you point it to our servers. If we register a domain on your behalf, it is considered your property and we will transfer it to you on request. In either case, domain registration and renewal fees are your responsibility.

7. Hosting and Maintenance

Your monthly hosting fee includes website hosting on fast, secure servers, SSL certificate (HTTPS), regular security and software updates, performance monitoring, and technical support via email.

We aim to keep your website available at all times but do not guarantee 100% uptime. Occasional downtime may occur for maintenance, updates, or circumstances beyond our control. We reserve the right to temporarily suspend your website if payment is overdue, the site is being used for illegal purposes, or a security issue requires immediate action.

8. Cancellation

You may cancel your hosting at any time — there is no minimum contract or lock-in period. To cancel, contact us in writing.

On cancellation, your website will remain live for 30 days after your cancellation date, giving you time to make alternative arrangements. After the grace period, your website will be taken offline and your data removed from our servers. You may purchase your source code before or during the grace period. If we manage your domain, we will transfer it to you on request.

We may also cancel your hosting by giving you 30 days’ written notice. In this case, we will refund any prepaid hosting fees for the unused period.

9. Refunds

Because you review and approve your website before making any payment, no refunds are offered once a site has gone live. You have the opportunity to request changes during the review phase at no cost, and you are not required to approve or pay for a site that doesn’t meet your expectations.

If we cancel your hosting, we will refund any prepaid hosting fees on a pro-rata basis.

10. Your Responsibilities

  • Provide accurate and lawful content for your website
  • Respond to our requests for information or feedback in a reasonable timeframe
  • Not use your website for any illegal, fraudulent, or harmful purpose
  • Not attempt to reverse-engineer, copy, or redistribute the website code without purchasing it
  • Keep your own backups of any content you provide to us

11. Data and Privacy

We take data protection seriously. In providing our services, we may process personal data on your behalf — for example, if your website includes a contact form or analytics.

We will only process personal data as necessary to provide the service. We will not sell, share, or use personal data for unrelated purposes. We comply with applicable data protection laws, including the Protection of Personal Information Act (POPIA) in South Africa.

If your website collects personal data from visitors, you are responsible for ensuring your own compliance with applicable privacy laws, including providing a privacy policy on your website.

12. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising from these terms or our services is limited to the total fees you have paid to us in the 12 months preceding the claim. We are not liable for any indirect, consequential, or incidental damages, including loss of revenue, data, or business opportunities, or for losses caused by factors outside our reasonable control.

Nothing in these terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded by law.

13. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the service after the changes take effect constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of Cape Town, South Africa.
